The National League for Democracy won a major victory taking 82 percent of the constituencies at stake in the Multiparty Democratic General Election held by the State Law and Order Restoration Council (SLORC) (now the State Peace and Development Council, SPDC) on 27 May 1990. Following that, the Commander-in-Chief of the Defense Services made the following promise to the nation at the coordinating meeting of the State and Divisional State Law and Order Restoration Councils held at the Army Commander-in-Chief Operations Room on 3 July 1990:
"... What will we do after the elections? We must draft the constitution. I have touched on the matter in my speech on 5 July 1989. I have said that the State Law and Order Restoration Council will not draft it. We do not intend to become any wrongdoer in history. ..."
"... The drafting of the constitution is a matter that must be done by the elected representatives from the political parties..."
Again, Paragraph 20 of Order No 1/90 released by the SLORC (now the SPDC) on 27 July 1990 officially stated that
"... under the present circumstances, the representatives elected by the people are those who have the responsibility to draw up the constitution of the future democratic State..."
However, the majority of the Pyithu Hluttaw representatives were not involved in the preparing of the Draft Constitution of the Republic of the Union of Burma 2008.
The authorities until now have not made public the Draft Constitution of the Republic of the Union of Burma 2008. They have, however, formed the "Commission for Holding Referendum for the Approval of the Draft Constitution of the Republic of the Union of Burma 2008."
If we study that commission, it becomes evident that the same person who is chairing that Commission also chairs the National Convention Working Committee, which guided the National Convention into adopting the "fundamental principles" and "detailed basic principles" of the constitution, as well as the 2008 State Constitution Drafting Commission. Likewise, several members of the Commission had also served as delegates to the National Convention and are also members of the State Constitution Drafting Commission.
This runs counter to the advices, suggestions, and demands of the international institutions, including the United Nations, which have asked for the inclusiveness of all parties concerned in the processes of drafting the state constitution and transforming the nation. We hereby declare that the unilateral action by the authorities is not only unacceptable to the people but is also detrimental to the national reconciliation process.
